Road Traffic Compensation - Why It's Not A Good Idea To Go It Alone
Appointing a solicitor can seem daunting and potentially expensive – you might be tempted to have a go online, say with a Will, conveyancing or even divorce, but in most cases an expert is what’s needed to get the compensation you deserve and only a professional is aware of the breadth of issues surrounding every case.
The Claimant was involved in a simple road traffic accident whilst taking her children to school. She was travelling in the outside lane along a main road when a car pulled out through the line of traffic colliding with the front of her car. She was able to drive home, but then started to feel pain in the left side of her neck into her shoulders and radiating down to her elbow.
She approached the Defendant Insurers who arranged immediate physiotherapy treatment. After 20 sessions she still had intermittent stabbing pain in her neck and shoulders. The insurers referred her to a Consultant Orthopaedic Surgeon and said she may wish to obtain legal advice from a solicitor.
She came to Pearson and we were able to obtain funding from the insurers for an MRI scan thereafter obtaining final opinion and prognosis from the expert, identifying that there was a claim for care and assistance for help provided by her husband with such things as taking the children to and from school, cooking meals and doing general household cleaning including ironing which the Claimant was unable to do.
“It is the extra things, the care and attention to details that a solicitor will bring to each case that can make all the difference,” said personal injury solicitor, Ian Wolstenhulme.
Settlement Out Of Court
Negotiations took place to obtain a settlement including compensation for psychological issues which had been identified by the medical expert and our client was happy with the outcome.
“This case shows the benefit of obtaining advice from a solicitor in relation to the various items of loss that can be claimed from an insurer in addition to pain and suffering. The outcome for this lady was better than she was expecting and she’s glad she googled us and did not go it alone,” said Ian.
