Compensation Claim for Slip on Ice

A women, who slipped on ice injuring her shoulder when a van blocked the pavement and she had to walk over uneven ground, got £3000 in compensation when we acted for her recently.

The 69 year old client was in Ashton town centre when the incident occurred.  Workmen had blocked the pavement with a van and she had to leave the footpath to walk around the parked vehicle, she walked across compacted snow which had become icy underfoot.

This was a difficult case as there was no CCTV or photographic evidence taken at the time of the incident.  When the other side provided photographic evidence our client said it appeared the van had been moved, as there was no metadata supplied to indicate a time and date so it could have justifiably been taken later,” said personal injury lawyer Lisa Anderson.

“This was a matter of public liability and so the cleaning company which owned and operated the van offered a split liability settlement of £3,000.

“Here the importance of getting photographic evidence at the time of the incident is important as it would have recorded all the data and evidence needed.  It might not be the first thing on your mind when you fall, your obvious concern is your pain and suffering, but before leaving the scene it’s good to get details of any witnesses and photographs if possible – just as you might with a car crash,” said Lisa.

Our client here injured her shoulder and hip and had an 18 month recovery period.
