Personal Injury Case resulted in £15,500 claim

Pearson Solicitors’ Personal Injury Team secured a settlement of £15,500 for a 68 year old gentleman after sustaining a serious fracture to his left leg following an accident which resulted in him requiring care.

Mr Jones, a 68 year old gentleman sustained serious fracture of his left tibia and fibula which was internally fixed in surgery using a locking nail.

The fracture itself healed well but during the course of his recovery there was a significant impact on Mr Jones’ ability to carry out daily living and care for himself and he required care and assistance from his partner who did not live with him.

In addition Mr Jones was unable to take up a new position as a private hire driver because the accident occurred the day before he was due to embark on his new employment.

Lisa Anderson explains, “So, in addition to a loss of earnings and care and assistance claim Mr Jones wished to include a claim for loss of enjoyment of a holiday. Although, he had been given the all clear by his GP to fly, Mr Jones was unable to enjoy the holiday as he would have done had he not had the accident.”

Medical Evidence Obtained

Medical evidence was obtained from a Consultant Orthopaedic who opined a full recovery would be achieved by Mr Jones by 18 months from the date of the accident with the aid of physiotherapy; and that it would be reasonable to accept that the significant impact on his daily living and working capabilities would continue for the first 16 weeks after the accident.

In addition to the personal injuries and the losses mentioned above Mr Jones also included a claim for travelling, parking, medical expenses and damaged clothing and the claim finally settled following negotiation with the Defendant’s insurers in the sum of £15,500.
