Discrimination at Work

Your legal employment rights provide protection to you against discrimination and harassment at work.

What is Discrimination and Harassment?

Discrimination and Harassment are covered by the Equality Act 2010 subject to the discrimination being in respect of one of the nine following protected characteristics:-

  1. Age
  2. Disability
  3. Gender reassignment
  4. Marriage and civil partnership
  5. Pregnancy and maternity
  6. Race
  7. Religion or belief
  8. Sex
  9. Sexual orientation

You do not need 2 years of continuous service to raise a claim for unlawful discrimination.

There are different types of discrimination and unlawful conduct which are set out in The Equality Act 2010 and which you may be able to base a claim on that apply to most and in some cases to all of the protected characteristics. These are:-

  • direct discrimination (Section 13)
  • indirect discrimination (Section 19)
  • harassment (Section 26)
  • victimisation (Section 27)
  • instructing, causing, inducing and helping discrimination (Sections 111 and 112)
