What is a protective award claim?

A protective award is an award of compensation that ARGLA employees will be entitled to if:

  1. At least 20 employees (including yourself) were made redundant / are about to be made redundant, in one establishment and;
  2. You were not consulted adequately prior to your redundancy

This means that the Company should have consulted with its employees,  either through a recognised trade union or elected representatives at least 30 days before making them redundant. If there was no trade union or elected representatives, the Company would have been required to arrange an election before consultation took place.

A protective award claim is separate from the statutory redundancy claim and no length of service is required. So, if you were affected by the administration of Architectural Glass and Aluminium Ltd you could receive two separate payouts on your redundancy.

How much could I be awarded?

Employees who worked for Architectural Glass and Aluminium Ltd could receive the maximum amount of 90 days' on their protective award claim.
