Embracing Constructive Separation in 2025
At Pearson our family team are busier than ever - already 2025 has seen a record number of clients coming to us with a wide range of family issues; from divorce and finances, separation and children issues, pension sharing, and of course clients just simply needing advice on those first tentative steps towards separation and divorce.
Resolution Code of Practice
As members of Resolution, (“a community of family justice professionals who work with families and individuals to resolve issues in a constructive way”) our family lawyers adhere to a Code of Practice “that promotes a constructive approach to family issues and considers the needs of the whole family.”
The Code covers not just how we will deal with our clients, but also our interactions with the other side, to resolve cases as amicably and expeditiously as possible.
“Whenever possible a non-combative approach is better for everyone,” said Family Law Solicitor, Terri Pickup
“By adhering to the Code, set out below, we support our clients at a difficult time with empathy and compassion, whilst also achieving the best outcome during what can be a distressing and stressful period for all involved,” she added.
Dealing with Divorce and Resolution
The principles are to:
- Reduce or manage any conflict and confrontation; for example, by not using inflammatory language.
- Support and encourage families to put the best interests of any children first.
- Act with honesty, integrity and objectivity.
- Help clients understand and manage the potential long-term financial and emotional consequences of decisions.
- Listen to and treat everyone with respect and without judgment.
- Use our experience and knowledge to guide clients through the options available to them.
- Continually develop our knowledge and skills.
- Use the Resolution Guides to Good Practice in day-to-day work.
The Guides to Good Practice expand on the above and assist Resolution members to achieve best practice with the following key areas:
- Communication
- Correspondence
- Domestic Abuse
- Working with our client and an unrepresented party
- Safeguarding Children
- Working with vulnerable client’s
“Our team have years of experience between us in family law and have come across just about everything over the years, however we are united in the knowledge that all family separations have a level of emotion attached. We like to think we are professional but sympathetic at the same time and these guides provide further assistance to solicitors working in this highly emotive and sensitive area of law,” added Terri Pickup.
In 2025 Resolution is focusing on the Code of Practice “The Year of the Code” to emphasise that when representing clients in family cases our approach remains constructive whilst ensuring the needs of the family and in particular the children are put first.
As members of Resolution we work with all involved to encourage a constructive and non-confrontational approach in all family matters.
