Compensation for a slip in Tesco supermarket
When Tesco denied all liability for our client who slipped in one of their stores, our Personal Injury solicitors took on the claim and recovered an out of court settlement of £3.300.
Injuries from a supermarket slip
In this case our client, who was out shopping with her family, sustained injuries to her back, neck, right knee and a bump to her head, after slipping in spilt yoghurt.
She reported the incident to a member of staff, and the store manager registered it in the accident book.
Our client went home following the incident, however she visited hospital two days later as her right knee back and head were still in pain.
Supermarket Liability
In the case Tesco Stores Ltd initially denied liability, they said the spillage had been caused by another customer who had not reported the hazard and as soon as they were aware of it they cleaned it up.
Tesco claimed they have a ‘clean as you go’ policy to ensure aisles are kept safe and clean, however as part of our claim we noted that the policy is not documented and Tesco were unable to provide daily inspection reports. Neither were they able to provide CCTV of the incident, even though it was confirmed as recorded by the store manager at the time.
Our client said there was member of staff in the aisle where the incident occurred, she was shelf-stacking and so the spilt yoghurt it should have been noted and dealt with.

Commenting on the case, Personal Injury Solicitor, Mike Talbot, said:
“The defendant, in this case Tesco Stores Limited, has a duty of care and they failed to take reasonable care that the claimant was safe whilst using its premises, allowed the floor to be dangerous, did not clean up any spilages and failed to institute or enforce an adequate system for the inspection and cleaning of the floor”
“This case hinged on the fact that although the supermarket chain say they operate a ‘clean as you go’ system this is not documented, as such there is no evidence to support that they were adhering to it.”
In a supermarket slip claims like this we acted for the client under a conditional fee agreement, whereby the client had no worries about the costs of the case as all expenses were taken from personal injury settlement.
