Ex-Axiom Ince employees win protective award judgment

Alan Lewis, Partner and Employment Law Solicitor at Pearson Solicitors and Financial Advisers successfully obtained a judgment valued at approximately £1.9 million for 153 ex-Axiom Ince Limited employees who were unlawfully dismissed following the collapse of law group.

Axiom Ince SRA intervention

Axiom Ince Limited ceased trading on 3rd October 2023 following an intervention by the Solicitors Regulation Authority (SRA), resulting in its closure and hundreds of redundancies from all 14 of its offices.

Judge Nicolle for the Tribunal ruled that the respondent (Axiom Ince Limited) failed to comply with its duties and that each of the claimants is entitled to a protective award of 90 days’ gross pay concluding that:

All claimants were dismissed without any consultation with appropriate employee representatives and with a failure to provide information about the proposed redundancies in writing prior to their dismissal.

Protective Award judgment

The Employment Tribunal issues a declaration that the respondent has failed to comply with its obligations under section 188 of the Trade Union Labour Relations (Consolidation) Act 1992 (TULCRA).

Employment Law specialist Alan Lewis at Pearson Solicitor said:

Pearson Solicitors are now ensuring that all 153 claimants they acted for receive their individual award which is guaranted by the Redundancy Payments Service (RPS).

Off the back of Pearson’s previous successful protective award case for Metamorph Group Services Ltd employees, in which Alan secured an award valued at £570.000 for 70 claimants, Alan added:

“This is another successful outcome against yet another law group that failed to follow appropriate consultation procedures regarding widescale redundancies. It just goes to show that no one is immune from companies that cease trading for whatever reason, not even in the legal profession but at least I can play an important part in getting what is due to those who through no fault of their own find themselves redundant.”
